Is Pennsylvania a no-fault insurance state?

Full Tort (Opt-out):

  • You can file a third-party insurance claim or lawsuit against the at-fault driver for all of your damages, including pain and suffering.
  • You are responsible for paying your own medical expenses and other losses until you win your case or settle with the at-fault driver's insurance company.

Which option is right for you depends on your individual circumstances. If you have serious injuries, you may want to opt out of the no-fault system so that you can sue the at-fault driver for all of your damages. However, if you have minor injuries, you may want to stay in the no-fault system to avoid the hassle and expense of a lawsuit.
